Jul 16, 2023Live updates: Sean ‘Diddy’ Combs trial, jury deliberates verdict, instruction concerns with juror No. 25 | CNN
A jury panel — made up of eight men and four women, ranging in age from 30 to 74 — is currently deliberating the legal fate of Sean “Diddy” Combs.
Here’s what we know about the jurors:
The jury in Sean “Diddy” Combs trial has been deliberating for about 10 hours.
The jury started deliberations yesterday around 11:30 a.m. ET and they were dismissed for the day around 5 p.m. ET. They returned to the court around 9 a.m. ET today.
The jurors have sent several notes to the judge, including a request for testimony transcripts.
The judge ordered the lawyers to send the transcript excerpts regarding the InterContinental incident to the jury by 1 p.m. ET.
The judge ruled that the jury will get the transcripts for Cassie Ventura’s testimony about the days before and after the incident at the InterContinental. The jury will also receive Ventura’s testimony regarding her Instagram post in response to the release of the InterContinental surveillance video, the judge ruled over an objection from prosecutors.
Prosecutor Emily Johnson said they could send the jury the testimony excerpts that are responsive to the jury’s other three requests now.
Prosecutors and defense attorneys are going back and forth on disagreements about what testimony excerpts are responsive to the jury’s request for Cassie Ventura’s testimony about the InterContinental incident.
As the jury continues to deliberate in the sex trafficking and racketeering conspiracy trial of Sean “Diddy” Combs, they have already sent several notes to the court with questions.
Today, they’ve requested the transcript of Daniel Phillip, the male revue manager who testified early in the trial that he was paid between $700 and $6,000 to have sex with Cassie Ventura on several occasions. The jury also requested any testimony from Ventura regarding her interactions or “Freak Offs” with Phillip.
Phillip was one of the first witnesses to take the stand when the trial began. He testified not only about being paid to have sex with Ventura, but also about an occasion when Ventura instructed him to urinate on her while Combs watched. Phillip further testified that Combs recorded them having sex on one or two occasions, using a phone and a camcorder.
During their first encounter around 2012, Phillip testified that he went to a New York City hotel expecting to perform at a bachelorette party. Instead, he found only Ventura and a man wearing a mask, whose voice he recognized as Combs. Phillip said he received money from Ventura “to have sex with her.”
Phillip recounted one incident in which he testified that he saw Combs shout at Ventura before “dragging her by her hair into her bedroom.” He said he heard Ventura screaming and repeatedly saying, “I’m sorry,” while also hearing what sounded like Combs slapping her. Phillip said he did not report the incident because he feared for his life.
“I was completely shocked and messed up in my head, there was nothing I could do,” he testified. “She was afraid I could see she was afraid.”
Judge Arun Subramanian is on the bench.
The jury sent a note at 10:15 a.m. asking for several transcript sections:
The parties are reviewing the transcripts to identify excerpts that respond to the jury’s request.
Sean “Diddy” Combs is back in the courtroom as we wait for more information about the jury’s latest note.
His sister and mother are also back inside the courtroom.
Dana Tran, who is the mother of Combs’ youngest child, is back in court today. She’s seated beside his mother.
The jury is asking for transcripts from two witnesses, prosecutor Maurene Comey said.
The jury has sent another note to the judge. Lawyers for both sides are reentering the courtroom now.
Defense attorneys and prosecutors are now adjourned following the brief court session this morning. Meanwhile, the jury is continuing deliberations.
Sean “Diddy” Combs stopped to talk to his mother, Janice Combs, seated in the gallery before leaving the courtroom with the marshals.
Combs leaned over and whispered to his mother, telling her he was heading back to a cell.
“Just relax, it’s gonna be alright.,” he said. He added that he loved her outfit. She is wearing a green and cream zebra print outfit.
Judge Arun Subramanian said he will send the jury a note saying, “In response to the jury’s question, the Court refers the jury to page 37, lines 1 through 3 of its jury charge,” and then quotes the language from the instructions. Those lines from the charge say:
“The word ‘distribution’ means actual, constructive, or attempted transfer. To distribute simply means to deliver, to pass over, or to hand over something to another person, or to cause it to be delivered, passed on, or handed over to another. Distribution does not require a sale.”
The judge rejected other proposed language from both prosecutors and defense attorneys. The defense had suggested referring the jury back to the full set of instructions or other parts of the charge, while prosecutors had proposed simply responding “yes.”
Judge Arun Subramanian is on the bench.
Toward the end of the day yesterday, the jury sent the judge a note with a question about the charges concerning the distribution of controlled substances. The judge said he would answer that question today.
Jurors in Sean “Diddy” Combs’ federal criminal trial will continue deliberations after over five hours of discussion yesterday.
Combs, 55, is charged with five counts — one count of racketeering conspiracy and two counts each of sex trafficking and transportation to engage in prostitution. If found guilty of the most serious charges, he could face up to life in prison.
